We operate as a Data as a Service ("DaaS") platform, providing business-related data and customized datasets (collectively, the "Service") designed to support informed decision-making within commercial organizations. By accessing or using our website, platform, and associated services, you ("you" or "your") acknowledge that you have read, understood, and agree to be bound by these Terms of Use ("Terms") in full. If you do not agree with any of these Terms, you must not use the Service.

2. Scope of Service

Clarity Data specializes in delivering business-oriented data solutions. This includes standardized data reports, API-based data delivery, and fully customized datasets tailored to meet your specific commercial requirements. All data provided is strictly business-related, containing no personally identifiable information ("PII") or consumer-level data.

3. Intellectual Property Rights

Unless otherwise stated, Clarity Data or its licensors own all intellectual property rights to the Service and materials made available through it. Subject to the limited license granted below, all such rights are reserved.

4. License to Use the Service

You may view, download for caching purposes only, and print pages or reports from the Service for your legitimate internal business use, subject to the following restrictions:

(a) You must not republish any material from the Service (including on another website or platform) or reproduce or store material from the Service in any public or private electronic retrieval system, except for authorized, paying customers who may securely store API/Report data for their internal purposes.

(b) You must not reproduce, duplicate, copy, sell, resell, or otherwise exploit any portion of the Service or the materials provided for any commercial purpose without our express prior written consent. Unauthorized resale or redistribution of Clarity Data content (for instance, via freelance platforms like Fiverr or Upwork) is strictly prohibited and may result in immediate termination of your account and legal action. We actively monitor for illicit reselling and may supply deceptive data to suspected illegal resellers to protect our intellectual property rights.

5. Accounts

To access certain features of the Service, you may be required to create an account using a valid, verifiable email address. You agree to maintain accurate and up-to-date registration information and to keep your login credentials confidential. You must not use parked domains, fraudulent methods, or multiple accounts to obscure your identity. We reserve the right to disable or terminate any account that violates these Terms or engages in suspicious activity.

6. Data Protection and Compliance (GDPR and LGPD)

Clarity Data is committed to complying with all applicable data protection laws and regulations, including but not limited to the General Data Protection Regulation (GDPR) in the European Union and the Lei Geral de Proteção de Dados (LGPD) in Brazil. We do not provide data related to identified or identifiable individuals. Our data is strictly business-oriented—focusing on company information, corporate hierarchies, industry categorizations, and other B2B metrics devoid of personal identifiers.

As we do not handle personal data, our activities typically fall outside the direct scope of GDPR and LGPD obligations related to individual privacy. However, we still maintain rigorous internal policies and safeguards to ensure that data is sourced, stored, processed, and transferred in a manner consistent with data protection principles. We continuously review our compliance framework to prevent the inclusion of personal information in our datasets. If, in exceptional circumstances, any personal information is inadvertently encountered, we will take swift action to remove it and ensure full compliance with applicable laws.

7. Payment, Subscriptions, and Custom Datasets

Clarity Data operates on a subscription and project-based billing model:

By subscribing to a monthly or annual plan, you authorize recurring charges to your chosen payment method until cancellation. It is your responsibility to cancel if you no longer require the Service, which can be done at any time via your account login.

For clients requiring specialized data, we offer custom dataset creation. Delivery times for custom datasets vary depending on complexity, volume, and data sourcing requirements. Before purchase, we will agree upon a delivery schedule and scope of work. We will make every reasonable effort to meet delivery timelines; however, delays may occur due to factors outside our control, in which case we will communicate promptly.

We do not issue refunds if you change your mind after purchase. Your rights may be protected under applicable law if the Service is faulty or does not provide the features promised.

Excessive requests, attempts to mass-export data, or non-internal commercial exploitation may result in immediate suspension or termination of your account without notice. For bulk or large-scale data needs, please consider our custom dataset services or inquire about expanded licensing options.

Enterprise and Team licenses are strictly for use by employees of the subscribing organization. You must not share access with non-employees, contractors, or other external parties without our explicit permission.

8. Limitations of Liability

To the maximum extent permitted by applicable law, Clarity Data, its owners, subsidiaries, affiliates, and licensors disclaim all liability for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with your use of the Service. We make no warranties or guarantees regarding the completeness, accuracy, timeliness, or reliability of the data provided.

Nothing in these Terms shall exclude or limit liability for fraud, death or personal injury caused by our negligence, or any liability that cannot be excluded or limited by law.

9. Restricted Access and Account Security

We reserve the right to restrict or disable access to certain areas of the Service at our discretion. If we provide you with a user ID and password, you must keep these confidential and are responsible for all activities under your credentials. We may, at any time and without notice, disable your account if we suspect abuse, fraud, unauthorized use, or other violations of these Terms.

10. Acceptable Use and Prohibitions

You must not use the Service in any way that may damage it, impair its availability or accessibility, or be deemed unlawful, fraudulent, or harmful. You agree not to use the Service for transmitting unsolicited communications (spam), engaging in illegal activities, or violating the rights of others.

You may not repurpose data from the Service to spam, harass, or otherwise unlawfully contact third parties. If you use the data for marketing outreach, it must comply with applicable laws and regulations, including but not limited to those governing commercial communications. Any misuse will be grounds for immediate termination of your access and may result in legal action.

11. Data Accuracy and Limitations

Although Clarity Data strives for accuracy and relevancy, information may become outdated, incomplete, or contain errors. Certain datasets rely on external sources or indicators that may lead to false positives or misclassifications. We do not guarantee uninterrupted, error-free data. Use the data at your own risk, and conduct additional due diligence where necessary.

12. Changes to the Service and Terms

We may revise these Terms from time to time. Changes will take effect upon posting the updated Terms on our website. Your continued use of the Service after changes have been posted constitutes your acceptance of the revised Terms. We may also modify, suspend, or discontinue any part of the Service at any time without notice.

13. Entire Agreement

These Terms, along with our Privacy Policy and any additional agreements expressly incorporated by reference, constitute the entire agreement between you and Clarity Data regarding the use of the Service, superseding all prior agreements and understandings.

14. Governing Law and Jurisdiction

These Terms and any disputes arising out of or relating to them or the Service shall be governed by and construed in accordance with the laws of the United States. Any legal actions or proceedings related to the Service shall be brought exclusively in the courts of the United States, and you consent to the personal jurisdiction of these courts.
